Using BCAT

Terms of Use

These terms govern access to BCAT Island Marketplace, the BCAT website, and related pilot, vendor, driver, and support services provided by Black Crescent Applied Technologies LLC.

Eligibility and acceptance

By using BCAT, you agree to these terms and our Privacy Policy. You must be legally able to enter this agreement and provide accurate, current information. If you use BCAT for a business, you confirm that you are authorized to act for that business.

An inclusive marketplace guided by principles

BCAT welcomes people and businesses of every race, ethnicity, nationality, and faith. Our work is informed by Islamic principles including honesty, fair dealing, dignity, responsible stewardship, and service to community. These principles guide conduct and platform decisions; they are not a religious or racial eligibility requirement.

Vendors are responsible for the accuracy of claims about their own products, including halal status, ingredients, cultural descriptions, availability, pricing, licensing, and other business representations.

Accounts and acceptable use

You are responsible for safeguarding your account and for activity performed through it. Do not misuse BCAT, impersonate another person, attempt unauthorized access, interfere with the service, submit unlawful or deceptive material, exploit another user’s information, or use the platform to discriminate unlawfully. BCAT may restrict access when reasonably necessary to protect users, vendors, the platform, or legal compliance.

Orders, vendors, and pilots

Participating vendors are responsible for their offerings, preparation, availability, fulfillment, refunds or remedies they authorize, and compliance with applicable laws. BCAT provides technology and coordination tools and is not the manufacturer or preparer of vendor goods.

Beta and pilot features may change, contain errors, or be unavailable. Nova’s current controlled pilot supports cash pickup and cash delivery by an approved assigned driver. Cash-delivery completion requires confirmation of the order total and remains pending reconciliation. Users should not enter card, bank, or government-identification credentials into pilot notes or support fields.

Pricing and future payments

Displayed vendor plans and service prices may be introductory, eligibility-based, or subject to a separate written agreement. Unless explicitly activated through an approved flow, test calculations and pilot records do not create an electronic charge. Taxes, delivery costs, tips, payment-processing charges, and third-party fees may be separate.

Content and intellectual property

BCAT and its licensors retain rights in the platform, software, branding, and original materials. Vendors and users retain rights in content they lawfully provide while granting BCAT permission to host, display, process, and transmit that content as needed to operate the service. You must have permission to submit content and may not infringe another party’s rights.

Disclaimers and limits

To the extent permitted by law, BCAT services are provided “as is” and “as available,” without guarantees that every feature will be uninterrupted or error-free. BCAT is not responsible for losses caused by unauthorized conduct, inaccurate vendor representations, third-party services, or events outside reasonable control. Any liability is limited to the extent permitted by applicable law. Nothing in these terms limits rights that cannot legally be waived.

Changes, termination, and governing law

We may update the service or these terms as BCAT develops. Continued use after an effective update constitutes acceptance where permitted by law. You may stop using BCAT at any time, and BCAT may suspend access for violations, safety, legal, or operational reasons. These terms are governed by Pennsylvania law, without overriding consumer protections that apply in your location.
